Terms of Service

1. Scope and Provider

These Terms of Service govern the use of the PERMA-Lead® App (hereinafter the “App”) on Android and iOS devices. The App is provided by:

By installing and using the App, you agree to these Terms of Service.

2. Subject of the Agreement

The App is a coaching app for leaders based on the PERMA-Lead® Model. It is available in two variants:

• Free: a free basic version with core features.
• Premium: a paid subscription with an extended feature set (see Section 3).

The usage agreement for the basic version is concluded upon installation and setup of the App. There is no entitlement to specific features, their further development, or the permanent availability of individual features, unless expressly agreed otherwise.

3. Premium Subscription (Apple App Store / Google Play)

The Premium subscription is concluded exclusively through the Apple App Store or Google Play. The purchase process, payment processing, and subscription management are handled through your Apple or Google account; the terms of use and payment terms of Apple or Google apply in addition.

• Conclusion and price: The subscription is concluded through the respective store. The applicable price is displayed to you in the store before you subscribe.
• Automatic renewal: The subscription renews automatically for the selected term unless it is cancelled no later than 24 hours before the end of the current subscription period.
• Cancellation: Cancellation and management of the subscription take place exclusively through the subscription settings of the Apple App Store or Google Play. Cancellation directly with the provider is not possible.

4. Right of Withdrawal (Digital Content)

As a consumer, you are generally entitled to a statutory right of withdrawal of 14 days when concluding a Premium subscription.

For contracts concerning the provision of digital content, the right of withdrawal expires prematurely if you have expressly consented to the performance of the contract beginning before the end of the withdrawal period and you have confirmed your knowledge that you lose your right of withdrawal by giving this consent at the start of performance (Section 356 (5) of the German Civil Code, BGB).

Since the Premium subscription is concluded through the Apple App Store or Google Play, the exercise of the right of withdrawal or refund is governed by the processes of the respective store. Please contact Apple or Google directly for this purpose.

5. User Obligations

When using the App, you are obliged to

• if you create an account, provide accurate information and keep your login credentials confidential (the App can also be used without an account),
• use the App only within the scope of applicable law and these Terms of Service,
• refrain from circumventing technical protection measures and from automated access to the App or the backend,
• refrain from reproducing, distributing, or making publicly available any App content (in particular impulses and texts) outside the App.

6. Availability and Liability

We strive to keep the App and the account features available without interruption. However, there is no entitlement to uninterrupted availability; in particular, maintenance work, updates, or disruptions beyond our control may lead to temporary restrictions.

We are liable without limitation for intent and gross negligence as well as for injury to life, body, or health. In cases of slight negligence, we are liable only for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected.

The content of the App serves personal development in the area of leadership and does not constitute psychological, medical, or legal advice.

7. Changes to These Terms of Service

We reserve the right to amend these Terms of Service with effect for the future, insofar as this becomes necessary due to changed legal requirements, technical developments, or the further development of the App, and you are not unreasonably disadvantaged by such changes. We will inform you of material changes in good time within the App or by email.

8. Governing Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence abroad, mandatory consumer protection provisions of the state of your habitual residence remain unaffected.
